Terms and Conditions of Service

The use of the services ("Services") provided on the ozbabesnguys.com website ("the Site") is governed by these Terms and Conditions of Use ("Terms"). These Terms constitute a legally binding agreement between you, the advertiser, and OZ Guy n babes, the operator of the Site. Therefore, it is crucial that you read and understand these Terms thoroughly before using the Services.

By registering to use the Site and its Services, you confirm that you have had adequate time to review and comprehend these Terms, and you agree to be bound by them. You also acknowledge and agree that these Terms integrate the Website Terms of Use, the Privacy Policy, and the Replacement and Refund Policy.

You must also implement your own safety procedures when interacting with advertisers.

By using this site, you release OZ Guys n Babes (including its affiliates, officers, directors, agents, subsidiaries, parent company, joint venturers, and employees) from any and all claims, demands, and damages, whether actual or consequential, known or unknown. This release covers any disputes you may have with users or visitors on the site, regardless of whether these disputes are related to legal matters, services, or equity. This includes, but is not limited to, disagreements about the performance, functionality, or quality of services provided by advertisers, and requests for refunds from users stemming from such disputes.

Account and Security

When you register for our Services on the Site, you'll receive a user account and password. It's crucial to keep this information confidential and not share it with anyone. If you suspect your account or password has been compromised without your permission, you must notify us immediately so we can disable your account. We aren't responsible for any losses incurred if your account is compromised or your personal information becomes publicly available. You acknowledge that all advertisements are public, and you are solely responsible for the information you choose to display publicly in your ads.

We reserve the right to disable your account or password at any time if we believe you've violated any of these Terms and Conditions.

By registering and using the Services on the Site, you confirm that all information you provide during registration is true and accurate. You agree to update this information regularly to ensure it remains current and complete.

How We Protect Your Information

  • We use 256-bit Strong SSL Encryption for transmitting sensitive data.
  • We use two-part login authentication every time you log in to your account.
  • We use a secure, PCI-compliant payment gateway to process credit and debit card details and payments. Your credit/debit card data is encrypted and sent directly to this secure, compliant payment gateway; we never store it on our servers.
  • Your account is protected by a password you choose. You are responsible for keeping this password confidential.

Payment Terms

For your advertisement to be published and displayed on our site, OZ Guy n Babes must receive your payment in full beforehand.

We'll notify you once your payment for advertising is received. We'll also send you a reminder before your advertising period ends, giving you the option to renew your existing advertisement or post a new one. If you choose not to extend your advertising period, OZ Guy n Babes reserves the right to remove your advertisement from the site until a new advertising period is purchased.

At our discretion, OZ Guy n Babes may occasionally offer a complimentary advertising period along with a gift voucher as part of a promotional campaign. If this occurs, we will inform you of the start and end dates of the free advertising period.

Third-Party Payment Gateways

All payments are processed via third-party payment gateways. Please be aware that OZ Guy n Babes has no control over, and is not responsible for, these external payment services.

By using our services, you acknowledge and agree that OZ Guy n Babes will not be liable for any loss or damage that may arise from your use of a third-party payment gateway. We strongly recommend that you read and understand the terms and conditions of any third-party payment gateway before using their services.

Advertiser Content Guidelines

When you submit any information or material for an advertisement (referred to as "Advertiser Content"), you must ensure the following:

  • Ownership and Legality: You possess all necessary rights and ownership of the Advertiser Content. It must not lead to a violation of any applicable laws, regulations, rules, codes, or other legal obligations by you or us.
  • Appropriateness: The content cannot be, or reasonably be considered, obscene, inappropriate, defamatory, disparaging, indecent, seditious, offensive, pornographic, threatening, abusive, inciting racial hatred, discriminatory, blasphemous, confidential, or a breach of privacy.
  • Solicitation and Rights: Your Advertiser Content must not be unsolicited, undisclosed, or unauthorized advertising. Furthermore, it must not infringe upon the intellectual property or other rights of any individual, entity, or corporation.

You are required to maintain all records necessary to verify that your Advertiser Content adheres to these requirements and make these records available to us upon reasonable request. Any opinions, advice, statements, services, offers, or other information within Advertiser Content are solely those of the respective advertiser and do not represent the views of OZ Guy n Babes.

Intellectual Property and Licensing

You retain ownership of your intellectual property rights in all Advertiser Content, including artistic works such as uploaded photographs and images. You grant OZ Guy n Babes a worldwide, royalty-free, sub-licensable, transferable, perpetual, irrevocable, and non-exclusive license to use, reproduce, publish, edit, translate, distribute, publicly perform, publicly display, and create derivative works from all such Advertiser Content. This license is specifically for the purpose of providing the Services, which includes, but is not limited to, promoting and redistributing all or parts of the Site (and its derivative works) across any media formats and channels.

Additionally, you grant each user and visitor of the Site a non-exclusive license to access and view your Advertiser Content through the Site. Both the license granted to OZ Guy n Babes and the license granted to each user and visitor of the Site will terminate within a commercially reasonable timeframe after you or OZ Guy n Babes remove the Advertiser Content from the Site.

Unauthorized Content and Our Rights

You grant OZ Guy n Babes permission and a license to engage a qualified third-party organization to remove any unauthorized copies of your Advertisement Content that infringe on copyright or have the effect of impersonating you.

We reserve the right to remove your Advertiser Content or terminate any advertisement without prior notice if you violate these Terms and Conditions. Our decision in such matters is final. We also reserve the right (though we are not obligated) to edit, retract, or delete Advertiser Content that we deem unacceptable or inappropriate, or for any other reasons, at our discretion and convenience.

You are responsible for all aspects of the production of your Advertiser Content and must adhere to the terms outlined in the "Prohibited Use" section.

Please be aware that all Advertiser Content is subject to any restrictions imposed by each relevant country, state, or territory. OZ Guy n Babes reserves the right to moderate Advertiser Content if it breaches our advertising policies or is considered inappropriate.

Prohibited Conduct

In addition to the prohibited uses detailed in the Advertiser Content Guidelines, advertisers are prohibited from:

  • Failing to comply with the requirements for Advertiser Content.
  • Accessing or using the Services if you are a minor.
  • Posting or transmitting any material or information that is offensive, defamatory, obscene, unlawful, vulgar, harmful, threatening, abusive, harassing, or ethnically objectionable.
  • Posting and content containing or promoting pyramid schemes, pornographic content, violence of any kind, and child abuse and/or pornography.
  • Creating advertisements or Advertiser Content that are fraudulent, defamatory, or infringe upon the intellectual property rights, confidentiality, or privacy of any individual.
  • Impersonating another person or entity, or falsifying or deleting any attributions, legal or other proper notices, or proprietary designations or labels regarding the origin or source of any materials.
  • Posting or transmitting any material or information that is outdated, inaccurate, or misleading.
  • Posting or transmitting any unsolicited advertising or promotional materials.

OZ Guy n Babes reserves the right to take any necessary remedial action, including, but not limited to, editing, retracting, or deleting any content or advertising content, or suspending and terminating access to the Site or Services provided by the Site.

Disclaimer of Liability

OZ Guy n Babes is not liable for any damages, injuries, or death arising from your use or operation of the Site or Services. This includes, but isn't limited to, issues caused by:

  • Performance failures, errors, or omissions
  • Service interruptions, deletions, or defects
  • Delays in operation or transmission
  • Computer viruses or communication line failures
  • Theft or unauthorised access to, alteration of, or use of records

This limitation of liability applies regardless of the cause of action, whether it's for breach of contract, tortious behaviour, negligence, or any other claim.

No Warranties

OZ Guy n Babes makes no representations or warranties, express or implied, regarding the completeness, accuracy, reliability, suitability, or availability of the Services for any purpose. Your reliance on any information provided through our Services is solely at your own risk.

Specifically, we do not warrant:

  • That any Advertiser Content you submit will be protected against loss, misuse, or alteration by third parties.
  • Any specific or guaranteed distribution or extent of distribution for your advertisements.
  • The accuracy, adequacy, or completeness of Advertiser Content, nor do we commit to keeping it updated.

We do not accept responsibility for any loss you may suffer as a result of relying on the accuracy or currency of information found on the Site or Services.

OZ Guy n Babes Intellectual Property

You are prohibited from using any part of this site to create derivative works, or to adapt, reproduce, store, distribute, print, display, perform, or publish its content without the prior written consent of OZ Guy n Babes. Commercializing any information, products, or services obtained from this site is also forbidden. Your use of this site is limited to the authorisations we provide. If you are an advertiser, you receive a limited, non-exclusive, revocable, and non-transferable right to display your content on the site as part of our services, subject to these Terms.

OZ Guy n Babes is the licensee of all intellectual property rights related to this site, encompassing its text, graphics, logos, icons, sound recordings, software, and trademarks. This excludes content provided by advertisers. These Terms of Use do not transfer any intellectual property rights from OZ Guy n Babes to you.

You must not use any of our intellectual property in the following ways:

  • Within any of your Advertiser Content.
  • As a whole or partial component of your own trademarks.
  • In relation to products, services, or activities that are not ours.
  • In a way that could be confusing, misleading, or deceptive.
  • In any manner that disparages us or our information, products, or services, including this site.

Limitation of Liability and Indemnity

You agree that we are not liable for damages incurred from using the Site, including copying, distributing, or downloading content (like Advertiser Content). We are not responsible for indirect, punitive, special, incidental, or consequential damages (e.g., lost business, revenue, profits, data, goodwill), regardless of cause (contract breach or tort), even if we were advised of such possibility.

We do not endorse Advertiser Content and disclaim all related liability. We do not verify Advertiser Content. We are not liable for user or third-party claims under the Competition and Consumer Act 2010 and/or Competition and Consumer Regulations 2010, including for misleading statements or misrepresentations in Advertiser Content. Advertisers are solely responsible for the accuracy of their content.

You are responsible for your data security and backups when using the Site. You will not claim against OZ Guys n Babes for lost data, re-run time, inaccurate instructions, work delays, or lost profits from Site use.

As a condition of using the Site, you agree to defend, hold harmless, and indemnify OZ Guys n Babes (and its successors/assigns) for all damages, costs, expenses, and liabilities (including legal fees) related to claims arising from:

  • Your Site access and use, including payment obligations.
  • Your breach of these Terms, applicable law, or others' rights.
  • Contractual or other claims between users and advertisers.
  • Liability from the tax treatment of payments.

This indemnity survives Term expiration or termination.

To the extent permitted by law, any otherwise implied conditions or warranties are excluded. If legislation mandates an implied condition or warranty that cannot be excluded or modified, it will be included. However, OZ Guys n Babes’ liability will then be limited to our Replacement and Refund Policy.

Termination of Access

We reserve the right to end or pause your ability to use the Site at any time, without prior notification.

We are not responsible for any claims or damages you or any third party may incur as a result of any such termination or suspension, or any other actions we take under these Terms.

Should applicable law mandate that we provide notice of termination or cancellation, we may do so by posting it on the Site or by sending a communication to any contact information (including email) we have on file for you.

Governing Law

This agreement, encompassing these Terms and all referenced documents, represents the complete understanding between you and OZ Guys n Babes regarding the Site. It supersedes all prior communications, negotiations, and arrangements.

The laws of Western Australia govern these Terms. Should a Western Australian court be unable to hear a dispute arising from this agreement, the laws of the Commonwealth of Australia will then apply. You consent to the exclusive jurisdiction of the courts in the relevant applicable jurisdiction.

Revisions to Our Terms

We may update these Terms periodically, exercising our sole discretion. Any modifications will be posted on the Site and will take effect immediately, unless stated otherwise.
